Read the Trump-world legal memo that a judge ruled was likely part of a criminal effort to overturn the election. [...] Chesebro's memo became public last week as a little-noticed exhibit in a legal battle between the Jan. 6 select committee and John Eastman, who conferred with Chesebro about that last-ditch strategy to delay or prevent the certification of Biden’s election. U.S. District Court Judge David Carter described the memo in his March ruling as perhaps “the first time members of President Trump’s team transformed a legal interpretation of the Electoral Count Act” — the law that governs the transition of power — into a day-by-day plan of action.” Carter wrote in his opinion that this memo “likely furthered the crimes of obstruction of an official proceeding and conspiracy to defraud the United States.” He ordered it released to the select committee under the "crime-fraud" exception to attorney client privilege. The strategy: The plan offered by Chesebro depended on the existence of competing slates of presidential electors in a handful of states where Biden won the popular vote. In fact, just a day after Chesebro sent his memo to Giuliani, pro-Trump activists gathered in several state capitals and signed documents falsely claiming to be the true presidential electors from their states.
Less than a year after the attack, a poll showed more than half of Republican voters opposed continuing to identify and prosecute the people who carried it out....Just after the riot, two-thirds of Republican voters said the presidential election results were marred by widespread fraud. Three-quarters of Republicans without a college degree held that view, according to a January 2021 poll by the center-right American Enterprise Institute. Half of Republicans said the left-wing group Antifa was mostly responsible for violence at the Capitol, a discredited theory advanced by some conservative commentators. Those views have hardened with time.
Fox News confirmed it will not broadcast or provide full live coverage on the first public hearing on the Jan 6, 2021, attack on the U.S. Capitol, which is set for June 9 in primetime. The long-awaited hearing will take place at the same time as Tucker Carlson and Sean Hannity’s usual slots, but the company said that it will cover the hearing only ‘as news warrants’ in a press release. Instead, it will broadcast the hearing on its business network, with Bret Baier and Martha MacCallum set to offer live coverage.Fox News’ disinterest in comprehensively covering the January 6 hearings is unsurprising but noteworthy, given the breathless, nonstop coverage they have lent to other political investigations in the past of much lesser magnitude, such as Benghazi.‘Fox News ran 1,098 primetime segments on Benghazi from the day of the attack until the committee hearings, which they carried live for more than 7 hours. Today they announced they won’t cover the hearings on the January 6th insurrection,’ said Sawyer Hackett, a Democratic communications strategist, in a tweet on Monday.

Former Trump White House chief strategist Steve Bannon has reportedly subpoenaed House Speaker Nancy Pelosi (D-CA) and members of the committee in an attempt to push back at the contempt charges he faces, according to CNN. Bannon is scheduled to go on trial next month in the contempt charges the Justice Department brought against him last year for failing to cooperate with the Jan. 6 Select Committee’s investigation.Late last year, Bannon was charged with two counts of contempt of Congress follow his refusal to comply with the committee’s subpoena. Bannon pleaded not guilty.In an effort to fight the contempt charges he’s facing, Bannon’s legal team reportedly subpoenaed 15 lawmakers and congressional staffers to testify at his trial next month, one of Bannon’s attorneys and copies of the subpoenas obtained by CNN indicated. The subpoenas reportedly target all nine members of the committee, three committee staffers and House general counsel Douglas Letter. Additionally, Bannon reportedly subpoenaed Pelosi and other House Democratic leaders such as Majority Leader Steny Hoyer (D-MD) and Whip Rep. Jim Clyburn (D-SC).

The former president also repeated his debunked claim that he ordered 10,000 National Guard troops to protect the Capitol. He increased the number to 20,000 in his statement."The Unselect Committee has now learned that I, as President, suggested & offered up to 20,000 National Guard, or troops, be deployed in D.C. because it was felt that the crowd was going to be very large," Trump wrote.The Washington Post found no evidence of such an order as far back as December....Further evidence also shows that those troops may not have protected just the Capitol. Mark Meadows, the White House chief of staff at the time, wrote in a January 5, 2021, email that Guard members were on standby to "protect pro-Trump people."

Based on some new reporting by Politico, we now know that Mike Pence's top lawyer, Greg Jacob, had authored a memo setting out how Pence would violate the law, specifically the Electoral Count Act, if he gave in to Trump's pressure and threats, and refused to perform his constitutional duty on Jan. 6 while presiding over the count of the electoral votes. Jacob is scheduled to appear and testify in the January 6 select committee public hearings in the coming days.
